CASE HISTORY OF A MARKET RENT REVIEW DISPUTE THROUGH QCAT

The attached case study  sets out the processes involved in a recent QCAT application initiated by an ARPQ committee member in relation to a disputed site rent increase following a market rent review. It details the numerous steps involved from the initial application to the final determination by a QCAT Member.

The purpose of the bulletin is not to deter members from undertaking the process but to assure them that having experienced the process, assistance and guidance is available should you go down this path. The bulletin also demonstrates strongly how inappropriate is the current QCAT system in determining a quite straight forward dispute.

It is the view of ARPQ that there is a need for a separate tribunal to be established to manage disputes arising from the Manufactured Homes Act and submissions on this issue have been made to government and will continue to be pursued.

You can assist in promoting this concept by making your local State Member of Parliament aware of the issues by onforwarding the bulletin with a request for assistance to achieve a more reasonable dispute resolution procedure.

As a footnote we can advise that the QCAT decision in the attached case resulted in a reduction of site rent by $11.50 per week.
